The United States Customs and Immigration Services (USCIS) is currently accepting comments on proposed amendments to the Code of Federal Regulations (CFR) for the collection and use of biometrics, including DNA. USCIS and the U.S. Department of State have been developing this proposal for several years and consulted with AABB throughout the process; the proposed rule references AABB’s Standards for Relationship Testing Laboratories 32 times.
The most significant change affecting AABB-accredited facilities is that USCIS would have the authority to require DNA testing for immigration cases, which is currently voluntary.
Interested individuals may submit written comments on the proposed rule before Jan. 2. The electronic federal docket management system will accept comments prior to midnight ET that day. Commenters can submit feedback through the Federal eRulemaking Portalhttp://www.regulations.gov/ by searching for DHS Docket No. USCIS-2025-0205 and following the site’s instructions. Comments must be in English or include an English translation.
USCIS noted that the most helpful comments will reference a specific portion of the proposed rule, explain the reason for any recommended change and include data, information or authority that support such recommended change.
